Terms & Conditions for Feng Shui Services
Effective Date: 3/2/2025
1. Introduction
These Terms & Conditions ("T&Cs") outline the agreement between The Modern Dragon Feng Shui ("we", "us", "our") and the client ("you", "your") regarding Feng Shui consultations and related services. By booking a service, you agree to these terms.
2. Scope of Services
We provide professional Feng Shui consultations, including assessments of homes, businesses, and environments based on Classical Feng Shui principles. Services may include written reports, verbal consultations, and recommendations tailored to your space.
3. Client Responsibilities
To ensure an accurate assessment, you agree to provide:
- Accurate property details, including layout, location, and relevant information.
- Access to your premises (if an in-person consultation is booked).
- Any requested information in a timely manner.
Accuracy of Information
The accuracy of the Flying Stars report relies on correct information about your property, including but not limited to the year it was built, major renovations or remodels, and roof replacements. If inaccurate or incomplete information is provided, this may render the report incorrect.
Reassessment & Fees
In the event that the report needs to be redone due to incorrect or missing information provided by the client, an additional charge of 85% of the package fee will be required to generate a new report.
4. Fees, Payment Terms & Consultation Commencement
- To commence a consultation, you must complete The Modern Dragon Feng Shui questionnaire in full.
- Service fees will be provided in advance and must be paid in full before the consultation, unless otherwise agreed.
- Payments are accepted via most internationally issued cards with a Visa, MasterCard, American Express, Maestro, Visa Electron, or Vpay logo.
- Late payments may result in service delays or cancellations.
5. Cancellations & Refunds
- Client Cancellations: All cancellations are non-refundable.
- Rescheduling: You may request to reschedule with at least 7 days’ notice, subject to availability.
- Consultant Cancellations: In the rare event we need to cancel, you will have the option to reschedule.
6. Liability & Disclaimers
- Feng Shui is a holistic practice and should not be considered a replacement for professional legal, medical, or financial advice.
- We provide guidance based on traditional Feng Shui principles; however, results may vary.
- We are not liable for any business or personal decisions made as a result of the consultation.
- Any recommendations, including furniture placement and adjustments, are at your discretion.
7. Photographs & Image Use
- As part of the consultation process, we require photographs of your property, both exterior and interior, for accurate analysis and report preparation.
- These images will be used strictly for documentation and the creation of personalised reports.
- On rare occasions, we may create an artistic interpretation of the front of your property based on a photo you provide or publicly available images, such as Google Maps. If we create such an interpretation, it will be provided to you as part of our service.
- We may also approach you to request permission to share this artistic interpretation on our social media channels or marketing materials. Any such use would be with your full written consent, and we would only reference the general location (e.g., district or country) without disclosing the specific address or identifiable details.
- If you have concerns regarding photographs, please discuss this with us prior to booking.
8. Confidentiality, Data Protection & Data Breach Policy
- Your personal data and property details will be handled in compliance with UK GDPR.
- We will not share or sell any client information.
- Consultations are confidential, and we will not discuss your case with third parties without permission.
Data Breach Policy
- In the unlikely event of a data breach, we will assess the impact and take immediate steps to secure affected systems.
- If a breach is likely to result in a risk to your rights and freedoms (e.g., exposure of sensitive personal data), we will notify you as soon as possible.
- If required under UK GDPR, we will report the breach to the Information Commissioner's Office (ICO) within 72 hours.
- We will provide guidance on any necessary actions you should take to mitigate potential risks resulting from the breach.
- Your personal data and property details will be handled in compliance with UK GDPR.
- We will not share or sell any client information.
- Consultations are confidential, and we will not discuss your case with third parties without permission.
9. Governing Law
These T&Cs are governed by the laws of England and Wales. Any disputes shall be subject to the jurisdiction of English courts.
